RFEs & denials
Should I respond to an RFE, withdraw or refile? What are the options after denial?
Updated: October 29, 2026
Choose based on the formal notice and individual facts. Responding, withdrawing, refiling, and filing a motion or appeal after denial involve different conditions, deadlines, costs and status consequences. Compare whether current evidence answers the concerns, whether eligibility existed at filing, and your status and timing constraints, then have counsel assess the options. Refiling does not guarantee approval; identify the original issues and substantive improvements first.
