USCOO O-1A preparation

Eligibility & petitioners

Do I need a lawyer for O-1, and who files the petition?

Updated: October 29, 2026

You are not required to hire a lawyer in every case. You can gather evidence and draft materials yourself, or choose legal review or full representation. Preparing materials yourself describes how materials are prepared; it does not change the petitioner requirements. An O-1 beneficiary cannot file a petition for themselves as an individual. A qualifying U.S. employer or U.S. agent can petition, and a separate legal entity owned by the beneficiary may also petition. Confirm who will petition and sign before choosing how to prepare.
